ALTERNATIVE DISPUTE RESOLUTION (ADR) / ONLINE DISPUTE RESOLUTION (ODR)

If you are a consumer and have filed a complaint regarding a contract concluded through the Site, but it was not possible to resolve the dispute in question, BeC will provide you with information regarding the Alternative Dispute Resolution bodies (so-called ADR bodies, as indicated in Articles 141-bis and following of the Consumer Code), specifying whether or not it uses such bodies to resolve the dispute. Additionally, we remind you that a European platform has been established for the online resolution of consumer disputes (so-called ODR platform). The ODR platform is available at the following link: https://ec.europa.eu/consumers/odr through the ODR platform, you can consult the list of ADR bodies, find the link to each of their websites, and initiate an online dispute resolution procedure. For any cross-border disputes relating to the application, execution, and interpretation of BeC’s General Terms and Conditions of Sale, if you habitually reside or have your domicile in an EU Member State other than Italy, you may initiate the European procedure for small claims established by Regulation (EC) No. 861/2007 of the Council, dated July 11, 2007, before the competent judicial authority, provided that the value of the dispute does not exceed EUR 5,000.00, excluding interest, rights, and expenses, at the time the competent judicial authority receives the application form. The text of the Regulation is available at https://eur-lex.europa.eu/eli/reg/2007/861/oj Finally, according to Article 49, paragraph 1, letter v) of the Consumer Code, if you intend to resolve a dispute arising with BeC, you may use the Joint Conciliation procedure. This procedure can be initiated if, after submitting a complaint to BeC, you have not received a response within 45 days or if the response you received is not satisfactory.
